    Topic Abstract

    A development which has been termed ‘evolutionary’ is blockchain. Depending on the nature of the platform using blockchain technology, its implementation has the ability to (a) reduce transaction time, (c) eliminate intermediaries, (c) reduce costs, (d) make transactions immutable.

    However, to implement this technology, we have to build the supportive eco-system for it (which includes the regulatory and legal framework governing its usage). A few of the regulatory and legal issues for implementation of blockchain projects to consider are:

  • The interplay between the framework of the blockchain network and the ordinary contractual and legal jurisprudence.
  • The question of immutability or finality of smart contracts will have to be balanced with the traditional modes of enforcement such as specific relief, interim orders and damages.
  • Process of sharing of information and storing of records while balancing existing data privacy laws and cyber security.
  • Manner for execution of contracts on blockchain to be reconciled with the provisions of the Indian Evidence Act, 1872..
  • Disclosures and ability of governmental bodies to be a part of the blockchain network and exercise control over the manner of functioning.
  • Role of a liquidator or insolvency professional in dealing with assets in a blockchain
